A woman who spent four days in prison custody and faced six months of legal battle after police arrested her for engaging in ‘extramarital affairs’ has now regained her freedom after a court in Lagos State threw out the matter for lacking substance.
The woman, whose name was given simply as Modupe, was on June 19 this year accused by her husband of having inappropriate relationships with other men and reported her at a police station in the state.
Policemen were said to have come to her house following the complaint from her husband. She was taken to the station after which she was arraigned at the Ogba Magistrate’s Court on June 23.
Modupe pleaded not guilty to the charge against her and she was granted ₦150,000 bail with two sureties in like sum, but because she could not perfect the bail conditions immediately, she spent four days in prison custody before she eventually perfected the bail conditions.
Her plight got the attention of an advocacy group, the Headfort Foundation for Justice, during one of its visits to the courts in Lagos State and on hearing about her situation, one of the lawyers decided to take up her matter.
The advocacy group announced the development on Friday, December 19, on its X handle, which added that the case was described by the magistrate as a family dispute and not one that should take up court’s time unnecessarily.
After the case suffered repeated delays and excuses, the matter finally came up on October 7, 2025, as the court declined another adjourned date due to the attitude of the prosecution, observing that the case had no business being in court.
The charges were struck out. Modupe was discharged and acquitted after spending four days in prison custody as well as facing six months of legal battle.
